General Terms and Conditions

1. Validity of the Conditions

a) These General Terms and Conditions (GTC) apply to all contracts concluded with HotelGast GmbH (hereinafter referred to as the Hotel) and a second (guest). They may be supplemented and/or replaced by terms and conditions negotiated in individual cases. 

2. Reservation Conditions

a) By reserving a hotel room, the guest offers to conclude an accommodation contract. If available, the Guest will receive a reservation or booking number. This result in an accommodation contract, this contract is binding for both parties. There is no claim to a specific room. The Hotel reserves the right to sell the room otherwise if the reservation is cancel.

b) Reservations of more than 10 rooms fall under the group regulation. Separate cancellation and payment conditions apply to these reservations. 

c) For a valid reservation, a valid credit card must be provide by the Guest at the time of booking or by means of payment offered on the electronic sales channels. The Hotel reserves the right to the immediately check the validity of the information provided and to make a pre-authorisation to a credit card provided.

d) The Hotel is also entitled to debit the credit card or alternative means of payment indicated at the time of reservation for any amounts owed by the Guest for open positions, in particular due to subsequent additions or the Guest’s conduct.

e) The Hotel reserves the right to cancel a reservation at any time. Any resulting claims for damages shall be limited to the total price of the stay booked.

3. Taxes, Fees, Charges

The applicable prices are gross total prices and include all statutory taxes, fees and charges. The Hotel reserves the right to adjust the prices accordingly in the event of a change in the rates of taxes, fees and charges and the effective levying of new taxes, fees and charges previously unknown to the parties. Accommodation rates shown per room and per night.

4. Terms of payment

a) On the day of arrival at the latest, the credit card or alternative means of payment will be charge with the full amount of the overnight stay and any services booked. If it is not possible to charge the credit card, the Hotel reserves the right to cancel the reservation. This shall result in the loss of the right to use the room by the Guest.

b) The acceptance and selection of credit cards is at the discretion of HotelGast GmbH in each individual case of presentation of a credit card, even if the basic acceptance of credit cards is indicate. 
The acceptance of cheques, credit cards and other means of payment is otherwise only because of performance.

5. Cancellations, Cancellation fees

a) The reservation can be cancelled completely free of charge up to 48 hours before arrival. In case of a later cancellation will be charged 80% for the first night. After check-in, a change of booking is no longer possible, free of charge. In case of early departure, the hotel is entitled to cancel. To charge 80% of the following night.

b) In case of no show of the guest (No Show) 80% of the first night of the booked stay will be charged, a further right of use of the room by the guest expires.

6.  Room use

a) The time of arrival is 15:00 hours of the booked day of arrival.

b) On the day of departure, the guest must vacate his hotel room by 11:00 a.m. at the latest and return it undamaged. A later departure can be arrange with the hotel upon request and availability. If the Hotel agrees to a later departure, the Hotel is entitled to charge a daily fee for the additional use of the room. For departures after 15:00 hrs, the full daily rate for the room will be charge.

7. Non-smoking in the Hotel

The entire hotel is a non-smoking area. Smoking is therefore prohibits in the public area as well as in the guest rooms. In the event of any violation, the Hotel has the right to demand compensation from the Guest for additional cleaning costs, including any loss of revenue due to the blocking of the room. The amount of damages shall be at least € 150.00. The amount may be higher or lower if the Hotel can prove higher damages or the Guest can prove lower damages.

8. Liability of the Guest

The use of electronic devices brought by the Guest, such as kettles, irons and hairdryers, not permitted for fire protection reasons. 
Should costs arise from the use of such devices, e.g. for fire alarm, damage to the inventory, the Guest shall be fully liable for these costs.

9. Pets

Pets are allows, after consultation with the Hotel, for a corresponding surcharge. However, pets are not allows in the food and drink area.
Exceptions are guide dogs, deaf dogs and other similar service dogs. These may be take along free of charge and at any time.

10. Domiciliary rights

The Hotel reserves the right to expel guests from the premises. This applies in particular if you do not follow instructions of the staff, discriminate, harass or endanger other guests.

11. Warranty and Liability

For the liability of HotelGast GmbH the §§701-703 of the German Civil Code (BGB) apply. Liability for other reasons is exclude, unless damage caused by HotelGast GmbH, its legal representatives or vicarious agents intentionally or through gross negligence.
In particular, HotelGast GmbH assumes no liability for personal items of the service recipient and third parties. 

12. Revocation (and cancellation of) Reservations and Services

If HotelGast GmbH has justified reason to believe that, the service recipient threatens to jeopardise the smooth business operations, security or reputation of the hotel, as well as in the event of force majeure (e.g. fire, strike, weather influences, etc.) HotelGast GmbH can cancel any service without being obliged to pay compensation. HotelGast GmbH can proceed in accordance with the regulations for cancellations as per clause I.6 and demand cancellation fees.

13. Other Provisions

a)  The headings are for convenience only and have no material meaning,       and in particular not that of a definitive regulation

b)  For these conditions and the entire legal relationship between HotelGast GmbH and The law of the Federal Republic of Germany applies to the service recipient.

c)  Place of jurisdiction is Ingolstadt

II. Special terms and conditions for Seminars and Conferences

1. Organizer

The organiser is deemed to be the person who acts as principal towards the hotel in the GVZ; if this person is not also the actual organiser, the organiser and the person acting as authorised representative are jointly and severally liable

2. Seminars

Seminars or conferences usually understood to be discussion rounds, training events, lectures, etc.

3. Reservations

Every reservation becomes effective and guaranteed only after written confirmation by Hotel im GVZ.

4. Revocation

See section I, point 12

5. Cancellations

A reservation can be cancelled free of charge up to 14 days before the event date.However, if the cancellation takes place within these 14 days before the date of the event, we reserve the right to charge 80% of the agreed total price as a cancellation fee.

6. Liability

The organiser is liable for damage or loss of equipment or inventory caused by the participants during the event, without proof of fault. Objects such as exhibits, decoration materials, demonstration equipment etc. shall brought in at the Organiser’s own risk and require prior agreement with the Hotel. Fire and trade police orders must be observe. The Organiser must bring valuables at his own risk. 

Insure costs against damage and loss. The objects themselves must be remove from the rooms/hotel by the organiser no later than 24 hours after the event. The Hotel shall only be liable for damage to or loss of other objects brought in or parked in the Hotel’s car park in the event of intent or gross negligence. See also section I, item 11.

III. Besondere Geschäftsbedingungen für Gruppen

1. Prices

Prices for groups are subject to a separate written agreement. Otherwise, the group price lists of the Hotel in the GVZ valid at the time shall apply.

2. Reservierungen

  1. In principle, II clause 3 applies accordingly to reservations and confirmations. The validity of any reservation for groups is otherwise subject to the payment of a deposit of 50%  of the services to be reserved, which must be received by the hotel 10 days prior to the arrival of the group for the reservation to be definitively effective.

3. Additional services

Any costs incurred in addition to the agreed contractual services, such as telephone, cash, etc., must be paid by each group member before departure. If this is not done the group organiser is jointly and severally liable.

4.  In all other respects, the above General Terms and Conditions of Business in Section I apply accordingly, in particular with regard to cancellation/cancellation fees.
